TRANSFERABLE LIFETIME LIMITED WARRANTY
FOR CUSTOM MADE VINYL REPLACEMENT WINDOWS AND DOORS

Subject to the terms, conditions and limitations set forth below, Kensington Windows, Inc. ("KWI") warrants to Covered Owners that its Custom Made Vinyl Replacement Windows (the "Windows") and Doors (the "Doors")(collectively, the "Products") will be free from defects in material and workmanship in manufacturing and will not chip, crack, peel, or blister, when used and installed in accordance with manufacturer's specifications.

WHO IS COVERED
This Warranty covers the original owner of the property at which the Products are installed (the "Covered Owner"). To be covered by this Warranty, the Covered Owner must continue to own an interest in the property.

PERMITTED TRANSFER
Subject to the limitations provided below, this Warranty may be transferred once within the first fifteen years of the date of installation by the original Covered Owner to a subsequent owner of the property (a "Permitted Transferee"). To transfer this Warranty, notice of transfer of title of the property must be sent to the Warranty Service Center, 1136 Industrial Park Road, Vandergrift, PA 15690, within thirty (30) days of the transfer. The notice must contain the name of the new property owners, a photocopy of this Warranty and a certified check for $75.00, to cover KWI's administrative costs in transferring the Warranty. A written reply will be sent confirming the transfer. As used herein, "Covered Owner" includes any Permitted Transferee. This warranty does not apply to any other transferee.

WARRANTY REGISTRATION CARD
Subject to the limitations provided below, if the Covered Owner is an individual, residential homeowner, the Warranty Period will commence on the date of installation of the Products and will continue as set forth in the special terms, conditions, and limitations as set forth herein. Subject to the limitations provided below, if the Covered Owner is a government agency, partnership, trust, religious organization, school, condominium or cooperative housing arrangement, or if the Products are installed in an apartment building or in any other type of building or premises not used by individual homeowners as their residence, the Warranty Period will commence on the date of installation and will last for a period of twenty (20) years. Subject to the limitations provided below, if the Covered Owner is a Permitted Transferee, the Warranty Period will last until the tenth anniversary of the permitted transfer or the fifteenth anniversary of the original date of installation, whichever comes first.

WARRANTY PERIOD

SPECIAL PROVISIONS OF THE WARRANTY
The following sets forth special terms, conditions and limitations of this Warranty:

VINYL FRAMES - KWI warrants to Covered Owners that the vinyl frames of the Products will not chip, crack, peel, or blister for the life of the product, when used and installed in accordance with manufacturer's specifications. The Warranty on wood grain foil laminates or painted Color Scape™ contained in any Solid Vinyl Window Unit(s) is limited to a ten (10) year Warranty Period from the date of installation. This Warranty does not cover any problems arising from any other applied finish, other than the optional interior wood grain foil laminate or Color Scape™ paint applied by KWI.

MOVING PARTS - KWI warrants to Covered Owners the moving parts of the Products will be free from defects in material for a Warranty period of fifty (50) years from the date of installation. If such defect occurs within 50 years from the date of installation, KWI will provide replacement moving parts free of charge. Postage/transportation charges are the responsibility of the Covered Owners. This Warranty provision expires completely after 50 years.

HERMETIC SEAL - KWI warrants to Covered Owners that Insulated Glass Units of the Products will be free from film formation caused by dust or moisture condensing on the internal glass surfaces for fifty (50) years from date of installation. If such defect occurs within 50 years from the date of installation, KWI will provide a replacement sealed glass unit free of charge. Postage/transportation charges are the responsibility of the Covered Owners. This Warranty provision expires completely after 50 years.

GLASS - KWI warrants to Covered Owners that glass used in the Products complies with Federal Specifications ASTM C1036.

SPECIAL GLASS BREAKAGE PROVISION - KWI warrants to Covered Owners that if the Insulating Glass Units of the Windows are accidentally broken by the Covered Owner within ten (10) years from date of installation, KWI will provide replacement Insulating Glass Units free of charge. Postage/transportation charges are the responsibility of the Covered Owner. This Warranty provision applies only to the Window. This Warranty provision applies only to the original property owner, this portion of the Warranty is not transferable to any subsequent owner of the property. This warrenty provision does not apply to laminated glass breakage as a result of storm damage.

WHAT IS EXCLUDED
All Windows are made for vertical installation in residential openings. To be covered by the Warranty, the Products must be installed in accordance with KWI's recommended installation techniques. This Warranty does not cover defects or damage to the Products caused by installation that does not comply with KWI's recommended installation techniques. This Warranty also does not cover defects or damage to the Products caused by abuse, alteration, tampering, improper maintenance, accident, negligence, or any other cause which is beyond KWI's control. KWI does not warrant that the Products will comply with any statutes, codes, ordinances, or regulations as ultimately used or installed. Compliance with local building codes, safety codes, and fire codes is the responsibility of the Covered Owner. Covered Owners are responsible for routine maintenance, service, and cleaning of the Products. Field applied caulking is generally used at the time of installation to seal the window frames to the surrounding wood, metal, or masonry jambs to prevent air and water penetration around the replacement window or door unit. Field applied caulking is not part of the window manufacturing process and is not covered by this Warranty. This Warranty does not cover condensation on the Products. Condensation is the natural result of moisture in the house and changes in temperature and humidity and does not indicate a defective window or door.

HOW TO OBTAIN KWI PERFORMANCE OF THE WARRANTY OBLIGATIONS
If you believe the Products or any part thereof are defective in a manner covered by this Warranty, you must submit a claim in writing (the "Claim") to KWI or the distributor, home improvement dealer or other business that sold you the Products within one (1) year after any defect or other basis for the Claim is discovered or should have been discovered. Any Claims submitted after such time shall be barred. Written claims should be directed to the Warranty Service Center, 1136 Industrial Park Road, Vandergrift Pennsylvania 15690. In your written notice of the Claim, you must provide a description of the Product, purchase price of the Product, and the date and location of purchase of the Product. In addition, your Claim should include a description of the nature of the problem, the date of installation of the Products and reasonable proof that you are covered by the Warranty. Upon receipt of the Claim by KWI, KWI will review the Claim to determine if it is covered by this Warranty. Inquiries should be directed to (800) 444-4972. KWI may require you to supply pictures or ship a representative sample, postage/transportation prepaid. If the Claim is covered by this Warranty, KWI will replace the defective part(s) or complete window unit(s) with new part(s) or new Product unit(s) at no charge (except as otherwise provided herein) in accordance with the terms of this Warranty. All replacement part(s) or complete window or door unit(s) will be shipped from KWI's manufacturing facility. Postage/transportation charges are the responsibility of the Covered Owner. Any Claims under this Warranty are expressly limited, at the option of KWI, to the (1) original cost of the Product or (2) the cost of replacing the defective Product or part of the Product. The costs covered by this Warranty do not include any labor or installation costs. The Warranty Period shall not be extended by the replacement of any Products but any replacement Products will continue to be covered during the remainder of the original applicable Warranty Period. KWI reserves the right to change, alter or discontinue any of its products at its sole discretion. If any part, component or complete window or door unit is not available at the time of any Claim by the Covered Owner under this Warranty, KWI reserves the right to substitute another product that it determines in its sole discretion is of substantially equal quality or value for the Product involved in the Warranty request.

ADDITIONAL LIMITATIONS ON WARRANTY
THE LIMITED WARRANTY PRINTED ABOVE IS THE ONLY WARRANTY APPLICABLE TO THE PRODUCTS. REPAIR OR REPLACEMENT BY KWI UNDER THIS LIMITED WARRANTY IS YOUR EXCLUSIVE REMEDY. KWI SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGE ARISING FROM A BREACH OF ANY EXPRESS OR IMPLIED WARRANTIES OR FOR THE COST OF REMOVING AS PROVIDED HEREIN OR INSTALLING OR REINSTALLING ANY REPLACEMENT PART, COMPONENT OR COMPLETE PRODUCT UNIT. IN NO EVENT SHALL KWI OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AUTHORIZED REPRESENTATIVES, AFFILIATES, SUPPLIERS OR CONTRACTORS, BE LIABLE FOR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DIRECT, SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND OR CHARACTER, INCLUDING, WITHOUT LIMITATION, FOR PERSONAL INJURY, DAMAGE TO REAL OR PERSONAL PROPERTY, EQUIPMENT, OR SURROUNDINGS, BUSINESS INTERRUPTION, LOSS OF REVENUE OR PROFITS, FAILURE TO REALIZE SAVINGS OR OTHER BENEFITS, OR THAT ARISE FROM DEFECTS OR ANY FAILURE OF PERFORMANCE, OR ANY CLAIMS BY ANY THIRD PERSONS, EVEN IF KWI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT WHERE PROHIBITED BY LAW AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, KWI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OF NON-INFRINGEMENT EXCEPT AS OTHERWISE PROVIDED HEREIN. ALL SUCH WARRANTIES ARE HEREBY EXPRESSLY EXCLUDED. NO STATEMENT, ADVICE, OR INFORMATION GIVEN BY KWI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AUTHORIZED REPRESENTATIVES, AFFILIATES, DEALERS, DISTRIBUTORS, SUPPLIERS OR CONTRACTORS CREATES ANY WARRANTY EITHER EXPRESS OR IMPLIED OR EXPANDS ANY WARRANTY HEREUNDER. THIS DISCLAIMER OF IMPLIED WARRANTIES MAY BE LIMITED OR INEFFECTIVE IF YOU ARE A CONSUMER, AS THAT TERM IS DEFINED IN THE MAGNUSON MOSS ACT, IN WHICH CASE THE DURATION OF ANY IMPLIED WARRANTIES SHALL BE IDENTICAL IN DURATION TO THE APPLICABLE EXPRESS WARRANTIES PROVIDED FOR HEREIN. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. BECAUSE SOME STATES AND JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, AND / OR LIMITATIONS ON THE DURATION OF IMPLIED WARRANTIES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
